of the conditions for personal data collection and processing
Since the protection of your personal data is our priority, please read this Information thoroughly.
This Information is provided in accordance with the Law on Personal Data Protection and its purpose is to inform you about the conditions for collection and further processing of personal data by Dunav Insurance Company a.d.o. Beograd, Makedonska 4, the insurance company registered as public joint stock company, identification number 07046898.
Please note that the Company collects and processes only those personal data and special category data (biometric data for the purpose of uniquely identifying natural persons and data concerning health) which are necessary for: conclusion, performance and execution of insurance, coinsurance, reinsurance and other contracts, collection of receivables under such contracts, settlement of claims and recourses, control of indemnity payments and complaints handling, and protection of Company’s legitimate interests. Personal data processing is also carried out for the purpose of on-line conclusion of insurance contract. If you do not provide the necessary data required for a specific type of contract, we will not be able to conclude and execute the contract. The processing of special categories of personal data is carried out upon a consent or clear affirmative action that signifies the agreement to the processing of personal data necessary for the conclusion, performance and execution of a contract.
We also access your personal data when you participate in our promotional events, visit our website or from other sources such as policyholders, publicly available sources, and other insurance companies and associations.
When you dial our telephone number to help us improve our services, your call to the Contact Centre may be recorded. We consider that by agreeing to talk to the Company’s operator you gave your consent for recording the conversation.
We observe personal data protection regulations and thus protect your privacy by processing personal data solely for the purposes for which they were collected. If the execution of a contract so requires, your data will be accessed by: insurance sales agents, reinsurers and coinsurers for ceding purposes, other insurance companies for the prevention of frauds or in relation to the obligations assumed under international treaties and conventions, government bodies, in accordance with the regulatory obligations of the Company (National Bank of Serbia, Association of Serbian Insurers, Serbian Ministry of Finance, Tax Administration, judicial and other government bodies and audit firms), financial institutions (banks), payment institutions, IT solutions providers, assistance services, claims handling services, healthcare institutions, lawyers, technical consultants and experts such as court experts, adjusters, repair shops, services of printing, delivery, storage or destruction of business documents, marketing and other business partners, processors processing personal data on behalf of the Company solely in accordance with the contract concluded with us. Your personal data will not be available to any person who is not authorized by the Company.
The Company processes personal data in order to protect its legitimate interests:
- fraud detection and prevention, attempted deceit and other offences in the conclusion of insurance contracts, and court and out-of-court settlement of claims and recourses;
- information about services offered by the Company – direct advertising based on published data of the benefits derived from our insurance products, market and customer satisfaction research in relation to Company’s services.
In relation to personal data collection and processing, you may exercise the following rights:
- right to access personal data – to check if and what kind of your personal data are processed,
- right to correct inaccurate personal data and to supplement incomplete personal data,
- right to anonymize/delete data and right to restrict the processing – having previously fulfilled legal requirements,
- right to withdraw a given consent – which does not impact the legitimacy of processing carried out upon the consent given before the withdrawal,
- right to object to processing,
- right to lodge a complaint with the Commissioner,
- right of data portability,
- right not to be subject to a decision based solely on automated means, including profiling.
You may exercise your rights in relation to personal data processing, including the withdrawal of a given consent, at any time, in person and solely in writing (on the form that can be found on the Company website or in the form of your choice), with clear confirmation of your identity. Consent withdrawal will not impact the legitimacy of processing carried out upon the consent and before the withdrawal.
Your personal data will be kept only for as long as reasonably necessary to achieve the purposes they were collected for or in order to comply with any relevant legislation and regulations. When your consent to process your personal data constitutes a legal basis, we will retain your personal data until you withdraw the consent.
We take all necessary measures to protect your personal data against disclosure, alteration, unauthorized access, misuse, loss and destruction and put in place all the necessary technical and organizational information security measures to protect the systems where we keep your data. We also take measures to control data access and personal data portability and availability. To protect your personal data, we bind our data processors with contracts. In the event that reinsurance is required, personal data protection is regulated in accordance with the Insurance Law by the conclusion of a separate contract with the reinsurer which further cedes the risk home or abroad. In rare cases when personal data are transferred to other countries, such transfer is carried out in accordance with the effective laws and international agreements, applying appropriate security measures (standard contractual clauses, certificates, contractual clauses between controllers and processors with the approval of the Commissioner).
